The Eighth Circuit observed this argument unpersuasive as it agreed with the Second Circuit that the "use" ingredient "is completely content for the functions of the youngster pornography statute if a youngster is photographed in order to build pornography." Id. The Court is happy that the governing administration has proved the second aspect of use further than a sensible question.
