In Jacobellis v. Ohio and other circumstances, the United States Supreme Court dominated that only "hardcore" pornography could be prohibited by obscenity legislation, with the relaxation shielded by the First Amendment. A distinction between "hardcore pornography" and "borderline pornography" (or "borderline obscenity") was made in the 1950s and nineteen sixties by American jurists discussing obscenity laws.
