The Complainant has therefore happy its stress on the 1st variable. A quantity of UDRP circumstances have established that, by virtue of paragraph 4(c) of the Policy, after a Complainant establishes a prima facie situation that none of the three circumstances establishing legitimate passions or rights applies, the load of creation on this variable shifts to the Respondent.
